How Car Warranties Work

A car warranty is a guarantee designed to protect you in case a part of your vehicle fails. Typically offered by a manufacturer or dealer, a warranty covers certain repairs or defect replacements, and it may also ensure that your vehicle will have a certain level of quality for a specified period of time. However, it doesn’t apply in all situations. When you purchase a new car, be sure to review any proffered warranties. Understanding how car warranties work will help you react in a crisis, respond to a recall, and stand up for your rights.

Types of Car Warranties

Express vs. Implied Warranties

Before we discuss how car warranties work, let’s explore the two types of warranty: express and implied.

An express warranty is a specific promise regarding your car’s repairs or quality that is communicated through text or speech. This includes a variety of warranties, including formal warranties provided in writing as well as advertising claims. All new cars and some used cars come with an express warranty covering almost all repairs for a specified period of time (three to four years is common). This warranty is sometimes known as a bumper-to-bumper warranty, because it covers (almost) everything between your vehicle’s two bumpers. Typically dealers will also try to sell you an extended warranty at an additional cost.

An implied warranty, on the other hand, automatically applies to all purchased cars except those purchased “as is.” An implied warranty of merchantability promises that the car will work as expected (taking its age and condition into account), and an implied warranty of fitness applies to vehicles purchased for specific tasks explicitly stated by the buyer (for example, driving up a steep driveway, driving in snow, etc).

How do I use a warranty?

As soon as you notice a defect, take your car to an auto shop for an assessment. If your vehicle’s warranty covers the problem, it can typically be fixed at no cost to you. Read the warranty carefully first to fully understand your coverage, and check the expiration date. In addition, keep all records and receipts related to your car’s maintenance and repairs, because you may need them someday for a warranty claim.

Who can perform the repair?

You can use whoever you like to perform the repair or replacement, including an independent mechanic, a retail chain shop, or a dealership. The Magnuson Moss Warranty Act, enforced by the Federal Trade Commission (FTC), makes it illegal for manufacturers and dealers to claim a warranty is void if you choose to use someone other than a dealership for a repair. The warranty may also not be rendered void if an aftermarket or recycled part is used. However, if a product or service is provided free of charge under a warranty, the manufacturer can require that you use select repair facilities and/or select parts.

According to the National Institute for Automotive Service Excellence, 70% of car owners use an independent mechanic for auto care (source). They rarely, if ever, return to the dealership for maintenance, a repair, or a replacement. If you’re concerned that your mechanic won’t offer the same level of service as a dealership, check to see that they are ASE-certified. The ASE blue seal tells you that the mechanic has undergone regular training, exams, and recertification to uphold a high standard of service.

Remember that if your warranty expires, you can also purchase a vehicle service contract to cover the costs of repairs. These protective agreements have different coverage levels and terms and conditions, so read your preferred contract carefully before purchasing.
